Government legislation, introduced on May 1st 1999, states that under law you can only fax private and public limited companies, charities and public sector organisations.

 

Only with prior written consent are you allowed to fax individuals, sole traders or partnerships.

 

Organisations can also register with the Fax Preference Service (FPS). This is government regulated, centrally held list of fax numbers that have effectively opted out of receiving unsolicited faxes. Stiff penalties of up to FIVE THOUSAND POUNDS PER FAX can apply to those organisations that do not ensure that fax broadcasts are FPS screened.

 

Touchdown screen all data against the FPS database at both the point of initial search and also at the very point of delivery to ensure that we are fully satisfied that our broadcasts are FPS compliant.

 

....but my customers depend on the information that I send them?

 

You can still send to a "closed" list of your valued customers only if you have obtained their prior consent, however, in order for Touchdown to deliver your broadcast to a closed list we would need written confirmation, from you, that all recipients of your broadcast have given prior permission.
